Mr.Sri Madan Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-01-2019 Heard the learned counsel for the petitioner and the learned counsel for the State.

The petitioner seeks regular bail in connection with L.N.M.U. PS case no. 52 of 2018 registered for the offence punishable under Sections 457, 427, 380 of Indian Penal Code. The allegation is regarding unknown persons having cut the A.T.M. machine by gas cutter and having taken away Rs. 8900/-.

The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case and infact, the petitioner was remanded in the present case after he was arrested in another case i.e. Town PS case no. 48 of 2018, in which the petitioner has already been

Patna High Court Cr.Misc. No.70442 of 2018(3) dt.11-01-2019 2/2 granted bail. The petitioner is said to be languishing in custody since 01.09.2018.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in connection with L.N.M.U. PS case no. 52 of 2018.
