The petitioner is in custody in connection with Kesaria P.S. Case No. 435 of 2019 for the offence under Sections 341, 323, 302 and 328 of the Indian Penal Code. Allegation against the petitioner is that he has administered poison to the deceased wife.

Learned counsel for the petitioner submits that the petitioner took the deceased to Kesaria hospital for treatement and in the way she died. He further submits that the deceased died due to over dose of medicine while she was in fasting on the eve of Teez. He further submits that the petitioner got no criminal antecedent and he is in custody since 04.09.2019. Considering the fact that the petitioner has got no criminal antecedent and he is in custody since 04.09.2019, the

No.85574 of 2019(4) dt.04-06-2020 2/2 petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Kesaria P.S. Case No. 435 of 2019 with the condition that the petitioner shall extend full cooperation in early conclusion of the trial. The court below is directed to expedite the trial and conclude the same at the earliest preferably within a period of nine months from the date of receipt/production of a copy of this order.
