1. Heard learned counsel for the petitioner and learned AC to GP-12.

The learned counsel appearing on behalf of the petitioner submits that the instant writ application has been filed seeking a direction upon the respondents to ensure the compliance of order dated 29.03.2022 passed by the respondent no.4 in Case No.127MP/2019, whereby and where under a direction has been given to the respondent no.5 to take steps for settlement of a piece of land appertaining to Thana No.296, Khata No.86, Plot No.02, measuring 5 decimal at MauzaGokhulpur of Chandi Block, District- Nalanda in favour of the
Patna High Court CWJC No.1615 of 2025(2) dt.20-03-2025 2/3 petitioner.

The learned counsel appearing on behalf of the petitioner submits that the respondent no.4 i.e. the S.D.O., Nalanda has issued a direction dated 29.03.2022 upon the Circle Officer, Chandi Block to settle the aforesaid piece of land in favour of the petitioner, when the S.D.O. himself is empowered to settle the land in favour of the petitioner, in terms of Policy No.109/71-2034 dated 15.03.1971 but then instead of exercising the power, the S.D.O. delegated the same to the Circle Officer without any jurisdiction. It is further submitted that one Bipin Ram @ Vipin Ram had approached this Court seeking identical relief by filing C.W.J.C. No.741/2025 and the same was allowed by an order dated 28.01.2025 (Annexure-P/7).

The learned counsel appearing on behalf of the State submits that since it is the contention of the learned counsel for the petitioner that the instant case is squarely covered by order dated 28.01.2025 in C.W.J.C. NO.741/2025, in that event, the writ application can be disposed of in the same term, to which the learned counsel for the petitioner also agrees.
5. After hearing the learned counsel for the parties, the writ application is disposed of in terms of the order dated 28.01.2025 passed in C.W.J.C. No.741/2025.
