The petitioners apprehend their arrest in a case registered for the offences punishable under Section 356 and 379 of the Indian Penal Code.

While the informant along with Neeraj Kumar was regressing to his house by bicycle, three motorcycle borne criminals including Ankit Kumar came from the rear side and Ankit Kumar snatched the mobile of informant, who was apprehended by the informant and his companion while two other managed to escape. The said Ankit Kumar disclosed the name of the petitioners as their fleeing accomplices and the owner of the motorcycle.

Patna High Court CR. MISC. No.83008 of 2019(2) dt.16-12-2019 2/2 It is submitted by learned counsel for the petitioners that the petitioners have no concern with the aforesaid occurrence. They have been falsely implicated in the case by Ankit Kumar due to animosity. There is nothing on record indicating the complicity of the petitioner in the occurrence barring the disclosure made by Ankit Kumar which has no evidentiary value in the eye of law. Petitioners have no criminal antecedent.

Learned APP for the State opposed the bail petition.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jahanabad in connection with Jahanabad P.S. Case No.764 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
