JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-02-2020 Petitioner seeks regular bail in connection with Special POCSO Case No. 129 of 2019, arising out of Mahila P.S. Case No. 77 of 2019 registered for the offence punishable under Sections 420, 406, 376 and 506 of the Indian Penal Code, Section 4 of POCSO Act and 66 I.T. Act.
Allegation as per F.I.R. is that the petitioner has had sexual relation with the informant victim girl and taken her to Rajgrih and thereafter apprehended by the police. Submission of the learned counsel for the petitioner is that as per Medical Report it appears that the age of the victim girl was assessed as 19 years. The petitioner is in custody for about seven months having no criminal antecedent. Heard learned A.P.P. for the State.
Having heard both the parties and in view of the
Patna High Court CR. MISC. No.83135 of 2019(4) dt.24-02-2020 2/2 submissions made above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions Judge Ist, Patna, in connection with Special POCSO P.S. Case No. 129 of 2019 arising out of Mahila P.S. Case No. 77 of 2019, subject to the condition that he shall extend full cooperation in early disposal of the Trial and shall present before the court below as and when required otherwise his bail bonds shall be cancelled.
