The petitioner seeks bail in Turkauliya P.S. Case No. 419 of 2018 instituted for the offence under Sections 272 and 273/34 of the Indian Penal Code, Sections 30(a), 38)1) and 41(1) of Bihar Prohibition and Excise Act, 2016. Counsel for the petitioner submits that from the seizure list it is apparent that recovery has been made from the field of Baliram Rai. Counsel for the petitioner further submits that police has prepared another seizure list showing recovery of 400 liters spirit from joint house of this petitioner and his two brothers namely, Arun Rai and Rajesh Rai. Petitioner is said to be in custody since 4.9.2018. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge of Excise Act, Motihari, in connection with Turkauliya P.S.
