JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 18-03-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Jadiya P.S. Case No. 205 of 2019 for the offenses under Sections 341, 353, 290, 504, 506 IPC and 37(C) and 45 of the Bihar Prohibition & Excise Act, 2016.

Allegation against the petitioner is that he was found positive in breath analyzer test.

Learned counsel for the petitioner submits that petitioner is in custody since 02.11.2019.

Considering the fact that the petitioner has remained in jail for more than four month, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/-

Patna High Court CR. MISC. No.82656 of 2019(3) dt.18-03-2020 2/2 (Twenty five Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cumSpecial Judge (Excise), Supaul in connection with Jadiya P.S. Case No. 205 of 2019, subject to the condition that immediately after release the petitioner shall report to the Civil Surgeon, Supaul so that his services may be utilized as volunteer in the District Health Centre, Supaul for a period of one month.
