03-12-2018 Heard Sri Binod Kumar Ambastha, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody in Darbhanga Sadar (Nagar) P.S. Case No. 124 of 2018 registered for offence under Sections 379 and 411 of the Indian Penal Code, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that present F.I.R. was lodged against unknown and subsequently, since petitioner was arrested in one another case without any rhyme and reason, the petitioner has been remanded in the present case and he is languishing in jail since 09-07-2018, whereas, learned Addl. Public Prosecutor submits that from the possession of petitioner, stolen motorcycle was recovered, which appears from the order of the learned court

Be that as it may, considering the nature of accusation and period of custody, let the petitioner namely Rakesh Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Darbhanga (Nagar) P.S.
