JUSTICE SANJAY PRIYA ORAL ORDER 28-11-2018 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner seeks bail in connection with Beur P.S. Case No. 154 of 2018 instituted for the offence under Section(s) 302/120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged in the written report that informant got informant on 25.5.2018 that his son , namely Gautam Anand was shot by fire arm by Golu Sonar, Abhay Rai and 3-4 other accused persons in the open field of Surya Mandir of Hulukpur. Thereafter, his son was taken to PMCH where he was declared dead. It is further alleged in the written report that SHO Beur P.S. has showed the video on mobile to the wife of informant in which her son has stated that Golu Sonar shot at

The petitioner is not named in the written report. The name of this petitioner has come during investigation in the confessional statement of co accused Mannu Kumar whose name has been disclosed by Golu Sonar. It has further been submitted that said Golu Sonar has already been granted regular bail by co-ordinate Bench of this court by order dated 6.10.2018 passed in Cr. Misc. no. 60413 of 2018.

The learned counsel for the informant has appeared and opposed the prayer for bail .

Petitioner is in custody since 22.6.2018 having no criminal antecedent.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VIII, Patna in connection with Beur P.S. Cse No. 154 of 2018 subject to the condition that both the bailers shall be the close relative of the petitioner (Sanjay Priya, J) shyambihari/- U T
