Earlier prayer for bail of the petitioner was rejected vide order dated 30.06.2017 passed in Cr. Misc. No. 21218/2017 with liberty to renew his prayer for bail in the court below if trial is not concluded within nine months. The report from the court below regarding present stage of trial has been received, wherein it has been mentioned that out of eight witnesses, five witnesses have been examined. Three witnesses including I.O. are required to be examined. In such circumstances, this Court is not inclined to grant bail to petitioner at this stage since the trial has progressed.
It is mentioned in the report that learned Sessions
Patna High Court Cr.Misc. No.70183 of 2018(3) dt.02-01-2019 2/2 Judge, Vaishali has been transferred and court is still vacant from 23.07.2018.
Learned counsel for the petitioner has submitted that petitioner is in custody since 17.11.2016.
This Court has been informed that now Sessions Judge has joined in Vaishali Judgeship.
Therefore, learned Sessions Judge, Vaishali is directed to conclude the trial as early as possible preferably within a period of three months from the date of receipt/production of a copy of this order and send compliance report. (Sanjay Priya, J) rakhi U T
