The petitioner seeks bail in Kudra P. S. Case No. 336 of 2019 instituted for the offence under Section(s) 420,409 and 120B of the Indian Penal Code.

The prosecution alleges that petitioner along with the others were engaged in facilitating unauthorized crossing at the check-post, of over loaded vehicles and that they were operating as "Entry Fafia".

It is submitted by the petitioner's counsel that there is no criminal antecedents of the petitioner. He is in custody since 01.11.2019. The amount of Rs. 1550/- allegedly recovered from the petitioner's possession and mobile phone from his bona fide possession, as they were his belongings. The others, who have

Patna High Court CR. MISC. No.85053 of 2019(2) dt.07-01-2020 2/2 been implicated with the petitioner and arrested with him, have been allowed bail in Cr. Misc. Nos. 80288 of 2019 and 82015 of 2019.

The learned APP for the State opposed the prayer for bail.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M. Kaimur at Bhabua, in connection with Kudra P. S. Case No. 336 of 2019 subject to the following conditions:- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled.
