Petitioner seeks bail in Chiraiya P.S. Case No. 172 of 2018 instituted for the offence under Section(s) 341, 323, 324, 307, 504/34 Indian Penal Code and Section 37(b) of the Bihar Prohibition Excise Act.

In the written report it is alleged that while informant and petitioner were going on the bus, some altercation took place between them for spreading the leg on which petitioner caused injury to the informant with knife on his back. Counsel for the petitioner submits that petitioner is in custody since 24.5.2018 having clean antecedent. Case diary has been received.

Patna High Court Cr.Misc. No.68195 of 2018(3) dt.12-12-2018 2/2 wherein the Doctor has found only one injury on person of the informant. There was no repetition of blow.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Motihari, East Champaran, in connection with Chiraiya P.S. Case No. 172 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
