====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 13-12-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Buxar Town P.S. Case No.652 of 2019 registered under Section 394 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. nor any incriminating was recovered from the house of the petitioner. In course of investigation, the police got recorded the confessional statement of the co-accused Lalu Kumar alias Vikash Kumar, as detailed in paragraph-35 of the case diary, in which he disclosed the name of the petitioner and some others as his associates. Except the confessional statement of the aforesaid co-accused,

Patna High Court CR. MISC. No.82771 of 2019(2) dt.13-12-2019 2/2 nothing has been collected the Investigating Officer, in course of investigation, showing the involvement of the petitioner in the present case. The petitioner has no criminal antecedent and is in custody since 03.10.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar, in connection with Buxar Town P.S.
