JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-12-2018 Petitioner prays for bail in connection with Bahera P.S.Case No. 215 of 2018 registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code. Allegation as per FIR is that daughter of the informant was called by co-accused Suman Mandal and then petitioner was also called at night and thereafter at 3 P.M. at night she was left on the road and thereafter informant inquired about her from Suman Mandal and he told that he left her at 3 O'clock in night and in the evening her dead body was found in the river.

Submission of learned counsel for the petitioner is that during investigation it has come that there was love affair between the daughter of informant and Suman Mandal and regarding her death there is no evidence available and moreover

Patna High Court Cr.Misc. No.68111 of 2018(3) dt.12-12-2018 2/2 it is Suman Maldal who called the deceased and petitioner is in custody for more than five months.

Heard learned APP also, who has opposed the prayer for bail stating that Suman Maldal had called the deceased and petitioner was also there.

Having heard both sides and in the facts and circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Benipur (Darbhanga), in connection with Bahera P.S.Case No. 215 of 2018, G.R. No. 240 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
