JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-11-2018 The petitioner seeks regular bail in connection with Saharsa Sadar P.S. Case No. 773 of 2017, registered for offences punishable under Sections 341, 323, 354, 308, 504, 506/34. Allegation against the petitioner and other accused persons is that they came to the house of informant and there is specific allegation against the petitioner that he assaulted the informant on his head by means of iron rod and there is further allegation against him that he disrobe the wife of informant and tried to commit rape upon her.

It has been submitted on behalf of the petitioner that although there is allegation against the petitioner is of assault to the informant by means of iron rod but the injury caused to him was found to be simple in nature and so far allegation of

Patna High Court Cr.Misc. No.68542 of 2018(2) dt.30-11-2018 2/2 disrobing the wife of informant is concerned, the same is false and concocted. It has also been submitted that there is land dispute between the parties and a title suit is going on and there is case and counter case. Petitioner has been in custody since 26.06.2018.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, in connection with Saharsa Sadar P.S. Case No. 773 of 2017, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
