Petitioner seeks bail in a case registered for the offences punishable under Sections 272,273,414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Recovery of liquor is alleged from a four wheeler. Submission is that neither the four wheeler is of the petitioner nor the liquor is of the petitioner. The person, who is owner of four wheeler, has already been allowed bail by a Coordinate Bench of this Court in Cr. Misc. No.55261 of 2019. A motorcycle was also seized which was of the petitioner though the petitioner was not present at the time of seizure of motorcycle.

No.86047 of 2019(2) dt.14-01-2020 2/2 Considering the fact that there is no substantial material against the petitioner for the purpose of prayer for regular bail, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Ladaniya Police Station Case No.118 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below as well as petitioner shall not leave the country without permission of the Court and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
