The petitioners seek bail in anticipation of their arrest in connection with Gogari P. S. Case No. 316 of 2018 / G.R. No. 2655 of 2018 instituted for the offences under Sections 341, 323, 354, 307, 379, 504
Patna High Court CR. MISC. No.83152 of 2019(2) dt.16-12-2019 2/3 and 34 of the Indian Penal Code and Section 27 of the Arms Act, 1959.
It is alleged that the petitioners and others, total 20 in number, came to the house of the informant variously armed and attacked the inmates. One Bechan Rai is said to have opened fire from his weapon which hit the brother-in-law of the informant, who is under treatment at the present. The belongings of the informant and other inmates of the house is also alleged to have been taken away.
Though the petitioners have been named in the F.I.R. but no specific accusation has been levelled against them.
There is a counter version of the occurrence also.
Some of the accused persons of this case with similar allegations have been granted anticipatory bail by a Bench of this Court vide order dated 22.10.2019, passed in Cr. Misc. No. 66700 of 2019.
Patna High Court CR. MISC. No.83152 of 2019(2) dt.16-12-2019 3/3 Regard being had to the afore-stated facts and taking into account the clean antecedents of the petitioners, the petition is allowed.
The petitioners, above-named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Gogari P. S. Case No. 316 of 2018 / G.R. No. 2655 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
