The petitioner seeks bail in connection with Ishak Chak PS Case No. 23 of 2019 registered under Section 406, 511, 419 and 420/34 of the Indian Penal Code. Allegation against the petitioner is that he got an insurance policy in the name of a person in the year 2016 and by producing forged death certificate of that person he tried to commit misappropriation of Rs. 4 lac.

Submission of learned Counsel for the petitioner is that he has falsely been implicated at the instance of the broker of the insurance policy and allegation against the petitioner is to attempt to commit fraud and he has not been financially benefited.

Considering the aforesaid submissions prayer for bail of the petitioner is allowed.

Let the petitioner above named be released on bail on his furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of CJM Bhagalpur in Ishak Chak PS Case No. 23 of 2019 subject to the conditions:- (I) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner. (ii) That the petitioner will be well represented on each date in the trial and if he fails to do so on two consecutive dates, his bail will be liable to the cancelled.
