JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-02-2020 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Pasraha P.S. Case No. 02 of 2019, G.R. No. 23 of 2019 registered for the offences punishable under Sections 366A/34 of the Indian Penal Code.

The statement of victim has been recorded under Section 164 of the Cr.P.C., in which, she specifically stated that she left her home by her own volition. The perusal of statement of victim goes to show that she has not whispered even a single word against the petitioners. No doubt, victim was found minor by the learned Magistrate, who recorded her statement but

No.4937 of 2020(2) dt.29-02-2020 2/2 taking note of the statement of the victim as well as submission of the parties, I think it proper to extend the privilege of anticipatory bail to the petitioners and, accordingly, it is ordered that the petitioners, above named, in the event of their arrest/surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Pasraha P.S.
