The petitioners seek bail in anticipation of their arrest in connection with Forbesganj P.S. Case No. 827 of 2019 dated 28.08.2019 instituted for the offence under Section 414 of the Indian Penal Code and Section 11 of Prevention of Cruelty of Animal Act.

Livestock cattle were found in a vehicle. It was suspected that cattle were being taken for being slaughtered. The vehicle is owned by the petitioner no. 1 and therefore he is being prosecuted in the present case. At the time of raid, petitioner no. 1 was not present. The petitioner no. 2 is not named in the FIR and it has been

Patna High Court CR. MISC. No.86101 of 2019(3) dt.17-06-2020 2/2 alluded to in the prosecution report that one unknown person had managed to run away when the vehicle was intercepted. Petitioner no. 2 appears to be perhaps the same person who had run away.

Regard being had to the nature of accusation against the petitioners, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No. 827 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.
