JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-11-2018 After some arguments, the learned counsel for the petitioner, faced with Clause 25 of the agreement entered into by the petitioner with the respondents, seeks permission to withdraw the present petition with liberty to approach the Bihar Public Works Arbitral Tribunal, Patna.

In above view of the matter, the present writ petition is disposed of as withdrawn with the aforesaid liberty. It is needless to state that in case, the petitioner files a reference case

Patna High Court CWJC No.21583 of 2018 (2) dt.22-11-2018 2/2 within a period of four weeks from today, no coercive steps shall be taken for recovery of the outstanding dues with regard to agreement no. 48 SBD of 2013-14 till the final disposal of the reference case/ the arbitral proceedings.
