The petitioner seeks regular bail in connection with Amas P.S. Case No. 196 of 2017 registered for the offence punishable under Sections 147, 148, 149, 323, 324,342, 427, 435, 436, 440 504, 506 and 120(B) of the Indian Penal Code, Sections 3⁄4 of Explosive Substance Act and Sections 13, 16, 18, 19, 20 and 38 of the UAPA Act.
The allegation of the prosecution is that a big group of Naxals had attacked M.W. Sawkala Plant at Gaya and had taken the employees and guards hostage on gun point whereafter the Porta Cabin used by the electrician was also put on fire and large scale damage was caused to the plant.
The learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.68927 of 2018(3) dt.09-01-2019 2/2 petitioner has not been put on T.I. Parade so as to ascertain his complicity in the matter as well as the petitioner is not a named accused persons in the present case. It is further submitted that the petitioner is having a clean antecedent and has been falsely implicated in the present case. The petitioner is stated to be in custody since 04.06.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Sherghati, District-Gaya in connection with Amas P.S. Case No. 196 of 2017.
