Petitioners are apprehending arrest in connection with Dhanarua P.S. Case No. 45 of 2013 for the offence under sections 341, 323, 504, 302 and 201/34 of the Indian Penal Code.
Learned counsel for the petitioners would submit that initially the case was registered under sections 341, 323, 504, 302 and 201/34 but cognizance was taken under sections 306, 201/34 of the Indian Penal Code.
Learned counsel submits that after investigation police has submitted final form against the petitioners and the
Patna High Court Cr.Misc. No.73912 of 2018(2) dt.18-12-2018 2/2 Magistrate differing with the police took cognizance. Considering the that the police after investigation has submitted final form against the petitioners, the court is inclined to grant bail to the petitioners, let the petitioners, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Masaurhi, Patna, in connection with Dhanarua P.S. Case No. 45 of 2013 subject to the condition as laid down under section 438(2) of the Cr.P.C. (Anil Kumar Upadhyay, J) Ravi/- U T
