ANJANA MISHRA ORAL ORDER 19-12-2019 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Hulasganj P.S. Case No.154 of 2019 registered for the offence punishable under Sections 341, 323, 504, 506, 509, 307/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that there is land dispute between the parties and the petitioners are own agnates. It is further submitted that the injuries found on the person of the victims, including the informant, are simple in nature and the petitioners' party have also received injuries. It is

No.84345 of 2019(2) dt.19-12-2019 2/2 further submitted that except Section 307 I.P.C, other offences are bailable in nature and even the provisions of Section 307 I.P.C. would not be attracted as there was no repetition of blows. Considering the aforementioned facts and circumstances and that the petitioners have clean antecedents, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Jehanabad, in connection with Hulasganj P.S. Case No.154 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
