The petitioner is in custody in connection with Mirganj P.S. Case No. 124 of 2019 for the offence under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner is in custody since 20.11.2019. He further submits that in the instant case total 18 litres of country made liquor was seized from Panchayat Bhawan and not from conscious possession of the petitioner.

Considering the fact that nothing was recovered from the conscious possession of the petitioner, the Court is inclined to grant bail to the petitioner. The petitioner, named above, is

Patna High Court CR. MISC. No.1048 of 2020(2) dt.28-01-2020 2/2 directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional District & Sessions Judge II, Gopalganj in connection with Mirganj P.S. Case No. 124 of 2019.
