2. Petitioner seeks regular bail in connection with Mufassil P.S. Case No. 345 of 2025 registered for the offences punishable under sections 191(3), 190, 126(2), 115(2), 117(2), 109, 352 & 191(2) of the Bharatiya Nyaya Sanhita.

3. The main submissions advanced by petitioner's counsel are that the present case is counter blast of the case filed by petitioner's side which is earlier in time and date bearing Muffasil P.S. Case No. 343 of 2025 and the FIR has been registered against 17 named persons, including the petitioner, and 25 to 30 unknown persons, and there is no specific allegation against the petitioner and six co-accused persons have been granted bail by a co-ordinate bench of this Court vide order dated 17.11.2025 passed in Cr. Misc. No. 71584/2025. It is further

Patna High Court CR. MISC. No.88860 of 2025(2) dt.12-01-2026 2/2 submitted that the petitioner is a 65 year old person, having no criminal antecedent and has been languishing in jail since 25.09.2025.

4. Learned APP for the State has opposed the prayer of the petitioner and submits that the informant's son was brutally assaulted and on his body, five fracture injuries were found.

5. Considering the above submissions, averments made in this application and mainly taking into account the petitioner's fair and clean antecedent, completion of investigation against him, coupled with the privilege of bail having been granted to six co-accused persons by a co-ordinate bench of this Court, this Court is inclined to release the petitioner on bail. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the court concerned in connection with Mufassil P.S. Case No. 345 of 2025.
