JUSTICE SATYAVRAT VERMA ORAL ORDER 29-01-2026 Heard learned counsel for the petitioner, learned APP for the State as well as learned counsel appearing on behalf of the informant.
2. Petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 117(2), 109, 302(2) and 3(5) of B.N.S., 2023.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that accused persons including the petitioner came on 04.09.2025 at 04:00 p.m. and petitioner assaulted him by an iron rod causing fracture of his hand and when his nephew Bhushan Kumar and Sonu Kumar came to save him, accused persons assaulted them by sword, rod and lathi causing injury and

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant on account of dispute relating to land. It is next submitted that the informant though is a senior citizen but very wisely settled the land of the petitioner with a Telecom company for setting up a tower and when petitioner and his side came to know about the said settlement, they approached the Telecom company and the Telecom company after being satisfied that the land belongs to the petitioner and his side, settled the issue by agreeing to pay the rent to the petitioner and his side, on account of which, an altercation took place in which both sides assaulted each other. It is further submitted that no doubt there is specific allegation of assault against the petitioner of assaulting the informant causing fracture of hand but then the injury suffered by the informant has opined to be simple, as such, allegation of assault causing fracture of hand is exaggerated to give seriousness to the case. It is also submitted that petitioner is not a criminal.
5. Learned APP for the State and learned counsel appearing on behalf of the informant opposes the anticipatory bail application. Learned counsel for the informant is not in a

No.87979 of 2025(2) dt.29-01-2026 3/3 position to rebut the submission of the learned counsel appearing on behalf of the petitioner that the injury suffered by the informant has opined to be simple in nature. It is also submitted that from the side of the petitioner Bihta P.S. Case No.706 of 2025 has been instituted against the informant and his side.
6. Considering the submissions made by the learned counsel for the petitioner, let petitioner, above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Bihta P.S. Case No.699 of 2025, subject to the conditions as laid down under Section 482(2) of the B.N.S.S.
