The petitioner seeks bail in Kalyanpur P. S. Case No. 20 of 2018 instituted for the offence under Section(s) 363 and 365, 302 and 201/34 of the Indian Penal Code. It is alleged in the written report that 7 years old niece of the informant is traceless. The informant has raised suspicion against co accused Md. Nirale in the written report. The police has arrested Md. Nirale and in his confessional statement he named several persons including name of Md. Jubair.

Learned counsel for petitioner submits that name of this petitioner has been taken by co villager Sikandar Khan

Patna High Court Cr.Misc. No.71200 of 2018(2) dt.11-12-2018 2/2 and Vinod Sahni in the further investigation which also finds mention in the impugned order. Besides suspicion, there is no any allegation of specific overt act against this petitioner. Petitioner is in custody since 10.9.2018.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM Samastipur, in connection with Kalyanpur P. S. Case No. 20 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner.
