The petitioner seeks bail in connection with Nokha P.S. Case No.140 of 2019 registered under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that save and except confessional statement of the petitioner, there is no other material to connect him with the alleged offence. Neither the looted motorcycle has been recovered from the possession of the petitioner nor he has been put on test identification parade.

Learned counsel for the State has opposed the prayer for grant of bail to the petitioner. He has submitted that in

Patna High Court CR. MISC. No.83716 of 2019(3) dt.17-03-2020 2/2 the confessional statement, the petitioner has admitted that he is a habitual offender. He has also contended that the petitioner has also confessed that he was involved in loot of a tractor earlier. Regard being had to the rival submissions of the parties, the petitioner, who is in custody since 03.09.2019, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand only) with two sureties of the like amount each to the satisfaction of learned ACJM-VI, Rohtas at Sasaram in connection with Nokha P.S. Case No.140 of 2019.
