The petitioner seeks bail in Ramnagar P. S. Case No. 162/18 instituted for the offence under Section(s) 304, 312, 313 and 314 Indian Penal Code.
The daughter of the informant was married with this petitioner two and half years ago Learned counsel for petitioner submits that police after investigation found the case true for the offence under Section 304 of the IPC.
In the postmortem report, the doctor has found cause of death due to excessive bleeding. The daughter of the informant was in Naihar at the time of death. Death had occurred due to excessive bleeding during the pregnancy period.
Patna High Court Cr.Misc. No.69984 of 2018(3) dt.19-12-2018 2/2 Learned counsel for petitioner submits that doctor who attended the victim girl and one of the witness whose mother was admitted just beside the daughter of the informant have given their statement which is available at para 47 and 54 of the case diary, wherein, they have stated that daughter of the informant was admitted in the hospital for treatment for having taken wrong medicine for abortion. The police after investigation submitted charge sheet u/s 304 IPC.
In the written report there is general and omnibus allegation levelled against this petitioner that daughter of the informant was done to death by him along with other family members.
Petitioner is in custody since 29.8.2018 Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the SDJM, Bagaha Dist. West Champaran, in connection with Ramnagar P. S. Case No. 162/18 subject to the condition that both the bailors shall be the close relative of the petitioner.
