2. The petitioner is seeking bail in connection with Excise P.S Sadar Bhojpur (Ara) P.S. Case No.335 of 2025, dated 19.11.2025 registered for the offences under Sections 30(a) of Bihar Prohibition & Excise Amendment Act, 2018.

3. As per the FIR, the police intercepted a pickup van bearing Registration No. BR03GB9078, apprehended the petitioner, and recovered 489.2 liters of foreign liquor from the vehicle.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. The petitioner has no connection with the alleged recovered liquor. It is further submitted that the petitioner is the

No.88089 of 2025(2) dt.23-12-2025 2/2 owner of the said pickup van and was unaware that his vehicle was being used to transport illicit liquor, as it is a commercial vehicle used daily by a driver. The petitioner has been in judicial custody since 19.11.2025. Lastly, it is submitted that the petitioner has no criminal antecedents.

5. Learned APP for the State vehemently opposed the prayer for bail.

6. Regard being had to the submission made by the parties and taking into consideration the period of custody of the petitioner, this Court is inclined to grant regular bail to the petitioner.

7. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise Court No. II, Bhojpur at Ara/ Successor Court, in connection with Excise P.S Sadar Bhojpur (Ara) P.S.
