The sole petitioner, apprehending his arrest in connection with Bhagalpur Mahila P.S. Case No. 83 of 2017 registered for the offence under Sections 420, 376, 323, 341, 504, 506, 509/34 of the Indian Penal Code, 1860 has prayed for grant of bail in the event of his arrest or surrender. In this case earlier by order dated 19.12.2018 case diary was called for, which has been received and kept on record, however, at the time of hearing of the present application learned counsel for informant has drawn my attention to order
Patna High Court Cr.Misc. No.71848 of 2018(4) dt.09-01-2019 2/2 dated: 06.09.2018 wherein the prayer for anticipatory bail of this petitioner was rejected by the court below. He submits that the anticipatory bail petition has not been rejected on merit, rather due to non -prosecution on behalf of the petitioner. In such view of the matter, there is no reason to entertain the prayer for grant of anticipatory bail. The anticipatory bail petition stands disposed of granting liberty to the petitioner to approach the court below and if such petition is filed, the learned court below may examine the same and pass appropriate order in accordance with law.
