The petitioner seeks regular bail in connection with G.O. Case No. 06 of 2018 arising out of Sakatpur P.S. Case No. 32 of 2018 for the offences punishable under Sections 8/20(b) (ii) of the N.D.P.S. Act.
The allegation is regarding recovery of 100 grams of ganja from possession of the petitioner as well as 100 grams of ganja from the possession of co-accused, namely, Mangal Chaupal @ Resham Chaupal, when they were apprehended by the police.
The learned counsel for the petitioner has submitted that the alleged recovery of ganja comes within small quantity under the N.D.P.S. Act, moreover, the same was not recovered
Patna High Court Cr.Misc. No.70517 of 2018(2) dt.12-12-2018 2/2 from possession of the petitioner. It is further submitted that similarly situated co-accused person, namely, Mangal Chaupal @ Resham Chaupal has already been granted bail by this Court by order dated 06.08.2018 passed in Cr. Misc. No. 45340 of 2018. It is stated that the petitioner has no criminal antecedent and he is languishing in custody since 02.06.2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Special Judge/ Sessions Judge, Darbhanga, Bihar, in connection with G.O. Case No. 06 of 2018 arising out of Sakatpur P.S. Case No. 32 of 2018.
