Mr. Ajay Kumar Jha, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 20-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in connection with Supaul P.S. Case No. 314 of 2018 instituted for the offence under Section 366A/34 of the Indian Penal Code.

In the written report the informant has alleged that his minor daughter had gone to recharge her Mobile phone and she became traceless. The informant raised suspicion against Rakesh Kumar Singh who is owner of Mobile Recharge Center. The victim girl on recovery has given statement before the police under Section 161 Cr. P.C. wherein she has stated that she was knowing petitioner from before. She has stated in her statement recorded under Section 164 Cr. P.C. that she had gone to different places with this petitioner. He has committed illegal act with her.

Patna High Court Cr.Misc. No.72152 of 2018(3) dt.20-12-2018 2/2 The victim girl has been medically examined wherein the Doctor has found no spermatozoa on her person. Counsel for the petitioner has enclosed copy of Aadhar Card of victim girl which shows that her date of birth is 1.1.1999.

Petitioner is in custody since 19.8.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul, in connection with Supaul P.S. Case No. 314 of 2018 subject to the condition that both the bailors will be the close relatives of the petitioner.
