2. The petitioners apprehend their arrest in connection with Barahiya P.S Case No. 212 of 2025 registered for the

Patna High Court CR. MISC. No.89988 of 2025(2) dt.23-12-2025 2/3 offences punishable under Sections 30(a) of Bihar Prohibition & Excise Act.

3. As per the prosecution case, total 355 litre of country made liquor and 500 litre of fermented liquor were recovered.

4. Learned counsel for the petitioners submit that petitioners have falsely been implicated in this case. It is next submitted that petitioners are innocent but merely on suspicion and local village politics, he has falsely been implicated in this case.

5. Learned counsel for the State opposes the prayer for bail of the petitioners.

6. From perusal of the F.I.R., impugned order and materials available on record it appears that petitioners was not arrested on the spot and no recovery was made from the conscious possession of the petitioners.

7. Considering the aforesaid facts and circumstances of the case, submissions made on behalf of the petitioners, let the above named petitioners be released on bail in the event of their arrest or surrender before the trial court within a period of six weeks from today on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to

No.89988 of 2025(2) dt.23-12-2025 3/3 the satisfaction of learned District and Additional Sessions Judge-IV-cum Exclusive Special Excise Court-I, Lakhisarai in connection with Barahiya P.S Case No. 212 of 2025 subject to the condition laid down under Section 482(2) of B.N.S.S and also with further condition that concerned police station shall verify the present and current address of the petitioners and petitioners shall reside within the jurisdiction of the concerned trial Court till conclusion of the investigation.

8. Let the copy of this order and E-mail be sent the Superintendent of Police, Lakhisarai forthwith for the compliance of this order.
