The petitioner seeks bail in connection with Bikramganj P.S. Case No.435 of 2019 registered under Sections 341, 323, 307, 379 and 387/34 of the Indian Penal Code. The accusation is that Chandan Kumar, the son of the informant Maya Devi, was standing near Durga temple. At that time, suddenly, Sinku Singh along with two unknown borne on Apachi Motorcycle came there and with an intention to kill the son of the informant, they attacked at him. In that course, Sinku Singh caused assault at the neck and head of the son of the informant through rod, due to which the son of the informant having become unconscious fell down. At that time, Sinku Singh snatched the gold locket from the neck of the son of the informant and took cash Rs.9000/- from his pocket. Thereafter, all fled away from there. On 'hullah' the informant, her family members and nearby people rushed there and took the son of the informant at Dhangai Government Hospital from where he was referred to P.M.C.H, where the treatment of the son of the informant was going on. Later on, the son of the informant died in course of treatment. Earlier, the demand of ransom of Rs.50,000/- was made by the aforesaid persons. Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R.

that on the basis of the fardbeyan of the informant, the present case was lodged against Sinku Singh and two unknown with the allegation of causing injury at the head and neck of her son by Sinku Singh through rod. The son of the informant died, later on, on 18.09.2019, in course of treatment after 20 days of the occurrence. In course of investigation, it has come that in the village, there were two teams, one was being led by Sinku Singh and another by Chandan Kumar, the son of the informant. In course of match, some quarrel took place in between the members of both the teams.

The petitioner has no criminal antecedent and is in custody since 02.10.2019. After investigation, the police has already submitted the charge-sheet against the petitioner.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Bikramganj, Rohtas, in connection with Bikramganj P.S. Case No.435 of 2019.
