The petitioner seeks bail in Special Case No. 02/2018, arising out of Sikty P.S. Case No. 25/2018, instituted for offences under Sections 20, 22, 23 and 24 of NDPS Act. Learned counsel for the petitioner has submitted that petitioner was not present at the time of alleged search. Seizurelist does not bear his signature. It is alleged in the written report that on secret information, police party reached at the house of petitioner and recovered 900gms of Ganja kept in two plastics. Son of the petitioner was found sleeping in the house. He was arrested by the police.

Learned counsel for the petitioner has submitted that

Patna High Court Cr.Misc. No.69983 of 2018(2) dt.03-12-2018 2/2 son of petitioner has already been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 38143/2018 dated 23.08.2018.

Petitioner is in custody since 02.08.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, NDPS Act, Araria in connection with Special Case No. 02/2018, arising out of Sikty P.S. Case No. 25/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
