The present application has been filed seeking cancellation of the regular bail granted to Opposite Party no. 2 by a learned Co-ordinate Bench of this Court vide order dated 21.06.2023 passed in Cr. Misc. No. 32929/2023 in connection with Aurangabad Town P.S. Case No. 320 of 2020 registered under Sections 406 and 420 of I.P.C.
3. Learned counsel for the petitioner submits that the O.P. No. 2 had agreed to return Rs. 2,00,000/- to the petitioner within two months of his release which is also mentioned in the order dated 21.06.2023 passed in Cr. Misc. No. 32929/2023. It
Patna High Court CR. MISC. No.89611 of 2025(3) dt.15-07-2026 2/2 is next submitted that the O.P. No. 2 has not returned the amount to the petitioner.
4. In these circumstances, this application stands disposed of with liberty to the petitioner to file an application in the court below and if the learned Magistrate finds that the amount of Rs. 2,00,000/- has not been given to the petitioner, he will cancel the bail bond of O.P. No. 2 forthwith.
5. The learned Magistrate shall decide the aforesaid application regarding cancellation of the bail bond within a period of two weeks from the date of its filing. (Sandeep Kumar, J) tusharika/- U T
