The petitioner seeks regular bail in connection with Sasaram Darigaow P.S.Case no.979 of 2018 registered for offences punishable under Section 392 of the Indian Penal Code.

Allegation is of snatching of the tractor of the informant and also snatching of the mobile of the driver. It appears that the mobile has bee recovered from the possession of the petitioner and later on the tractor was recovered, for that Navi Nagar P.S.Case No.179 of 2018 has been registered. Submission of the learned counsel for the petitioner is that recovery of the tractor has already been made prior to confession of the petitioner as such it can not be said that on the

Patna High Court Cr.Misc. No.70688 of 2018(3) dt.18-12-2018 2/2 basis of the confession, the tractor has been recovered. So far mobile is concerned, he has purchased the same in good faith. He is in custody for about 4 1⁄2 months.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Rohtas at Sasaram in connection with Darigaow P.S.Case no.979 of 2018..

With the aforesaid observation, this application is allowed.
