Petitioner apprehends his arrest in a case registered under Sections 147, 148, 149, 323, 307, 337, 338, 353, 427 of the Indian Penal Code.

Informant is the police officer, who has alleged that on receiving secret information about carrying the illegal sand on the trailor attached with tractor, informant alongwith other police personnel reached at Harhangi Tola, and upon seeing the police party, all started to flee away leaving tractor loaded with sand and nine motorcycles but after chase seven miscreants were apprehended and the apprehended persons also indulged in scuffle with the police. The local Chaukidar disclosed the name of 22 persons including the petitioner.

Patna High Court CR. MISC. No.82931 of 2019(2) dt.13-12-2019 2/2 It has been submitted on behalf of petitioner that petitioner is not named in the FIR. His name has surfaced in this case only because he was owner of the seized tractor and he has no knowledge about the said fact. Similarly placed co-accused persons have been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 02.09.2019 passed in Cr. Misc. No. 55537 of 2019, vide order dated 17.10.2019 passed in Cr. Misc. No. 62695 of 2019 and vide order dated 25.11.2019 passed in Cr. Misc. No. 73746 of 2019 respectively.

Considering the facts and circumstances of the case, prayer of anticipatory bail is allowed and petitioner named above in the event of arrest or surrender before the court below within four weeks from today, Petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of learned court below, in connection with Koilwar P.S. Case No. 202 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
