The petitioner, who is in custody, seeks bail in connection with Bihta PS Case No. 571 of 2019, registered under Sections 302, 307, 326, 34 of the Indian Penal Code and Section 27 of the Arms Act.
The allegation in the FIR, in so far as the petitioner is concerned, is that he was one amongst the others who have indulged in indiscriminate firing in a wedding ceremony while witnessing a dance, which has hit some persons. The petitioner along with Shere Bihar Nut and Dharmendra Nut are similarly situated. Both the said co-accused persons have been allowed bail in Cr. Misc. No. 78697 of 2019. The petitioner has no criminal antecedent and he is in custody since 5.7.2013.
Learned APP has opposed the prayer for bail.
Considering the rival submissions, prayer for bail of the petitioner is allowed.
Let the petitioner above named be released on bail on his furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two
Patna High Court CR. MISC. No.83560 of 2019(3) dt.20-03-2020 2/2 sureties of the like amount each to the satisfaction of ACJM I, Danapur, District Patna in Bihta PS Case No. 571 of 2019 subject to the following conditions:- (I) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner. (ii) That the petitioner will be well represented on each date in the trial and if he fails to do so on two consecutive dates, his bail will be liable to the cancelled.
