Earlier the prayer for bail of the petitioner was rejected twice -firstly by the then Hon'ble Co-ordinate Bench fo this Court, vide order dated 25.6.2018 passed in Cr. Misc. No.34062 of 2018 and again vide order dated 6.3.2018 passed in Cr. Misc. 5233 of 2019.

Case is under Section 302 of the Indian Penal code . Submission of the learned counsel for the petitioner is that he is in custody for two years and even the evidence of one witness has not been concluded.

Heard the learned APP as well as the learned counsel for the informant, who has opposed the prayer for bail on the ground that there is allegation against the petitioner also and in order to withdraw the case the present occurrence took place.

No.87093 of 2019(3) dt.28-02-2020 2/2 In view of the submission as made above, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to conclude the trial and try to conclude it within a period of six months and if not concluded, the petitioner is at liberty to renew his prayer for bail.
