The petitioner seeks bail in Ghoswari P.S. Case No. 20/2017, instituted for offences under Sections 364/34 the Indian Penal Code.
It is alleged in the written report that on the date of occurrence son of informant, namely, Mohit Yadav, had gone to see Durga Puja Festival in village Prahladpur, but he did not return back. The informant started searching his son and visited at village Prahladpur where he got information from villagers that the petitioner along with other have taken away his son from Durga Puja Pandal. The informant raised suspicion that accused persons might have killed his son and disappeared his dead body.
Patna High Court Cr.Misc. No.71170 of 2018(2) dt.04-12-2018 2/2 Learned counsel for the petitioner has submitted that CDR location of mobile of son of informant was found elsewhere. The other co-accused with similar allegation has already been granted bail by a co-ordinate Bench of this Court on the aforesaid ground in Criminal Misc. No.39458 of 2017 dated 21.09.2017.
Petitioner is in custody since 07.08.2018.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Judge-cumACJM, Barh at Patna, in connection with Ghoswari P.S. Case No. 20/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
