The petitioner seeks regular bail in connection with Sidhwalia PS case no. 205 of 2019 instituted for the offences punishable under Sections 30(a) of Bihar Prohibition & Excise Act, 2018.

The allegation is regarding recovery of 10 liters of illicit liquor from a bush situated behind the house of the petitioner.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that though the petitioner is an accused in some criminal cases, however he is on bail in the

Patna High Court CR. MISC. No.83342 of 2019(2) dt.17-12-2019 2/2 said cases. The petitioner is said to be languishing in custody since 07.11.2019. Lastly, it is submitted that neither any illicit liquor has been recovered from the possession of the petitioner nor from his house.

Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-IIcum-Special Judge, Excise, Gopalganj in connection with Sidhwalia PS case no. 205 of 2019.
