JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-12-2018 The petitioners seek regular bail in connection with Alamnagar P.S. Case No. 153 of 2018, registered for offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioners and others is of firing on the husband of the informant causing his death. It has been submitted on behalf of the petitioners that they have falsely been made accused in this case along with six others named accused and five to six unknown persons. Further submission is that no specific allegation has been attributed to the petitioners rather only general and omnibus allegation has been levelled and there was only one gun shot injury on the person of the deceased. Patna High Court Cr.Misc. No.71537 of 2018(3) dt.21-12-2018 2/2 have been in judicial custody since 19.07.2018. Learned counsel for the State opposed the prayer for bail on the ground that soon after occurrence, the petitioners were also seen fleeing away from the place of occurrence. Having heard both sides, considering the facts and circumstnces of the case, I am not inclined to enlarge the petitioner son bail.
This application is accordingly dismissed.
However, the petitioners are at liberty to renew their prayer for bail, once charge is framed.
