Mr.Sri Zainul Abedin ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 11-01-2019 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in Harnaut P.S. Case No. 355/2017, instituted for offence under Section(s) 302/34 of the Indian Penal Code.

It is alleged in the written report that on the date of occurrence these petitioners along with other accused persons caught hold the cousin father-in-law of informant. Co-accused Radhe Yadav is alleged to have assaulted her cousin father-inlaw Mahesh Yadav with Kudal. Learned counsel for the petitioners has submitted that petitioners are said to have caught hold the cousin father-in-law of informant. In case diary witnesses in their statement before

Patna High Court Cr.Misc. No.74541 of 2018(3) dt.11-01-2019 2/2 the police have also alleged against Radhey Yadav of causing injury to the cousin father-in-law of informant. Post-mortem report is available in case diary wherein several injuries have been found on the person of deceased but no any specific allegation has been made against these petitioners of causing any of those injuries. Petitioners are in custody since 09.06.2018. Considering the aforesaid facts and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda, Biharsharif in connection with Harnaut P.S. Case No. 355/2017, subject to the conditions that both the bailors shall be the close relative of the petitioners. (Sanjay Priya, J) rakhi/- U T
