2. In this case, the petitioner is seeking regular bail in connection with Kabaiya P.S. Case No. 307 of 2025, registered for the offences punishable under Sections 329(4), 126(2), 115(2), 74, 303(2), 308(3), 324(4), 352, 351(2), 3(5) of the BNS.

3. As per the prosecution case, the petitioner along with other co-accused persons entered the informant's house, broke open the shop lock, and used filthy language against the female members of the informant's family.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. There is dispute between the informant and the petitioner, as brother of the petitioner is tenant in the premises of the informant.

5. On the other hand, the learned senior counsel for the informant has opposed the prayer for bail by submitting that the petitioner outraged the modesty of female members of the informant and also looted some rupees.

6. The petitioner is under custody for near about two months, and co-accused persons have been granted bail.

7. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Kabaiya P.S. Case No. 307 of 2025, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

8. The petitioner shall physically appear before the learned court below on each and every date. In case of failure on two consecutive dates, unless he is prevented by extremely adverse circumstances, the learned court below will be at liberty to cancel the bail bonds of the petitioner.
