The petitioner seeks bail in a case registered for the offence punishable under Sections 401, 413 and 414/34 of the Indian Penal Code.

Stolen motorcycle is said to have been recovered from the in-laws' house of the petitioner and the petitioner was apprehended.

It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He has also no concern with the other accused persons of the occurrence. He has been falsely implicated in this case. The motorcycle has been purchased by the petitioner without knowing it to be a stolen one. No F.I.R. has been lodged against

Co-accused, namely, Munna Sardar @ Munna Sadar, Binod Sardar and Ashok Sardar have been enlarged on bail by co-ordinate Benches of this court vide order dated 01.04.2019, 28.03.2019 and 03.05.2019 passed in Cr. Misc. No. 17149 of 2019, Cr. Misc. No. 18945 of 2019 and Cr. Misc. No. 20403 of 2019 respectively. The petitioner has been languishing in custody since 30.12.2018.

Learned APP for the State opposed the bail petition.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Supaul in connection with Chhatapur P.S. Case No.370 of 2018.
