JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-12-2019 The petitioners, who are persons of clean antecedents seek bail in anticipation of their arrest in connection with Begusarai Town P.S. Case No. 664 of 2019 dated 10.11.2019 instituted for the offences under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

It appears that a raid was conducted in the house of one Kanhaiya Kumar and 13.12 litres of liquor was recovered. One Munna Kumar is stated to have been arrested at the time of raid who disclosed the name of the petitioners.

Patna High Court CR. MISC. No.83477 of 2019(2) dt.17-12-2019 2/2 Learned counsel for the petitioners has submitted that beyond the confession of the arrested accused person, there is no other material against the petitioners.

Considering the aforenoted aspect of the matter, the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Begusarai in connection with Begusarai Town P.S. Case No. 664 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
