The petitioner is in custody in connection with Sour Bazar P.S. Case No. 331 of 2018 for the offences under Sections 302, 201, 120(B)/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has no criminal history and he is in custody since 04.06.2018.

Learned counsel for the petitioner submits that there is no eye witness to the incident and only on suspicion the name of the petitioner surfaced in the instant case as he is cousin of the father of the second wife of the victim.

Considering the period of custody and the fact that petitioner has not criminal antecedent, let the petitioner, named

Patna High Court Cr.Misc. No.71752 of 2018(3) dt.09-01-2019 2/2 above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Learned Chief Judicial Magistrate, Saharsa in connection with Sour Bazar P.S. Case No. 331 of 2018.
